Classified information in Polish defence tenders – reading the tender requirements

In Polish defence and security procurement, classified information requirements appear in the contract notice, tender documents and draft contract. Here is what to check.
Checklist
- the highest classification level at the tender stage and during performance,
- the required certificate level – „at least level III” is also met by level II or I,
- required validity of the certificate and personnel clearances,
- how classified tender documents will be made available,
- subcontractor commitments and information required under Article 407,
- the industrial security instruction in the draft contract and related penalties.
Timing
Industrial security proceedings should take up to 6 months from a complete application and personnel vetting up to 3 months, so certificates and clearances must be obtained well before the tender is published.
