KRiBSI individual opinion – request, fee and deadlines
Published: · Maksymilian Kruszewski
From 28 October 2026 a company can ask the Polish Commission for the Development and Safety of Artificial Intelligence (KRiBSI) how the AI Act applies to its specific case. The request costs PLN 150 and the answer is due within 30 days.
How it works
KRiBSI is the Polish market surveillance authority for AI systems. An opinion covers one issue – a system already in use or a planned deployment – and is based on the applicant's description. The rules are set out in Articles 8–18 of the Polish Act of 3 July 2026 on artificial intelligence systems (Journal of Laws item 1003).
Fee and deadlines
The fee is PLN 150, paid before filing (Article 11(1) of the Polish Act on AI systems). The Commission has 30 days, or 60 days in particularly complex cases (Article 12(1) of the Polish Act on AI systems). If it misses the deadline, the opinion is deemed consistent with the applicant's position (Article 12(3) of the Polish Act on AI systems) and the fee is refunded.
Pitfalls
- The opinion protects only the facts as described in the request.
- Draft your own position as if it were the opinion – it may become one.
- Opinions are published in anonymised form; flag trade secrets in the request (Article 17(1) of the Polish Act on AI systems).
How we help
We assess whether a request makes sense, describe the system clearly and prepare the legal position and attachments.
